Latest Update Regarding Overtime Rule

The Department of Labor filed an appeal of the recent federal Court’s decision to halt the new overtime rule increasing salary requirements for certain exempt employees. Because the appeal process can be lengthy, and it is uncertain what effect the new administration will have on this issue, employers are encouraged to continue what they’ve been doing since November 22 when the federal Court granted the emergency motion for a preliminary injunction to stop the rule. At this time, the injunction is still in effect and the new rule did not take effect on December 1st.Blethen, Gage and Krause will continue

FLSA Overtime Rule Suspended

UPDATE: As you probably know, the final Fair Labor Standards Act's (FLSA's) overtime rule was set to go into effect Thursday, December 1. A federal judge in Texas put the brakes on the Department of Labor's (DOL's) new federal overtime rule, which would have doubled the FLSA's salary threshold for the "White Collar" exemptions from overtime pay and would have automatically adjusted the threshold every three years beginning in 2020. While the ultimate impact of this decision is unknown, the court's decision on Tuesday, November 22, 2016 was welcome news for many employers who have been struggling with the impacts
